## US EB-5 Requirements

The EB-5, also known as the USA Immigrant Investor program, was created through the Immigration Act of 1990 (IMMACT90) by the United States Congress. The program was established to stimulate the U.S. economy by granting permanent residency to foreign entrepreneurs along with the right to work in the United States after they have invested in an American commercial enterprise. The Immigrant Investor Pilot Program was launched in 1993 by Congress to increase interest in the EB-5 visa program.

To be able to apply for this program, you should be at least 18 years of age, in good health, and without a criminal record.

## Main Applicant Requirements

- Invest the required qualifying capital in a new commercial enterprise
- Document the lawful source and path of the investment funds
- Create, or demonstrate that the investment will create, at least 10 full-time jobs for qualifying U.S. workers
- For Regional Center cases, file Form I-526E in connection with a qualifying USCIS-designated Regional Center project
- Meet the applicable U.S. immigrant-visa or adjustment-of-status admissibility requirements

Congress created the EB-5 immigrant investor category in 1990. The current framework was substantially revised by the EB-5 Reform and Integrity Act of 2022.

## Legal Basis

EB-5 is the fifth employment-based preference category under INA section 203(b)(5). It receives 7.1% of the worldwide employment-based immigrant visa level. Of the EB-5 allocation, 20% is reserved for rural investments, 10% for high-unemployment-area investments and 2% for infrastructure projects. The EB-5 Reform and Integrity Act of 2022 substantially revised the Regional Center Program and introduced additional integrity requirements.

## Costs of EB-5

To qualify for EB-5 classification, an investor must invest the required capital in a qualifying new commercial enterprise and satisfy the applicable job-creation requirements.

## 1) Requirements

Under just one EB-5 application, an EB-5 investor, their spouse and their unmarried children under the age of 21 are all eligible to receive green cards. The investor must be able to provide complete documentation of the legal source of the funds. This source of funds can be in the form of Record of salary, bank, business, or personal loan, mortgage, property sale, or inheritance. There are no requirements in terms of business experience, language skills, or education.

## Application Process For USA EB-5

There is no single fixed EB-5 processing timeframe. Timing depends on petition type, USCIS adjudication, visa availability, country of chargeability and whether the applicant uses consular processing or adjustment of status.

1. Savory & Partners will pre-screen your passport copy for government pre-approval. You must make a down payment of our professional fees to open your application.
2. Savory & Partners' professional team will assist and advise you to collate the documents required according to the U.S. Government checklist.
3. File Form I-526E for a Regional Center investment or Form I-526 for a standalone investment. USCIS adjudication times vary.
4. After USCIS approval, consular-processing cases proceed to Department of State/NVC processing when an immigrant visa is available.
5. After immigrant-visa issuance, enter the United States before the visa expires. The investor and qualifying derivatives then become conditional permanent residents for 2 years.
6. File Form I-829 during the 90-day period immediately before the second anniversary of conditional residence. If approved, USCIS removes the conditions on permanent residence.
